Lawful Basis for Using Your Information

Personal information is used where necessary to respond to an enquiry, provide a requested service, manage a booking, deliver photographs, maintain business records, or meet legal and accounting obligations.

The lawful basis for using personal information may include:

Contract, where information is needed to provide photography services.
Steps taken before entering into a contract, such as responding to an enquiry or checking availability.
Legitimate business interests, such as managing client communication, improving services and keeping appropriate business records.
Legal obligations, such as maintaining accounting and tax records.

Where photographs are used for website, social media, portfolio, blog, promotional or marketing purposes, this will be based on permission, a written agreement, legitimate interest, or consent where appropriate.

You may withdraw consent for future promotional use at any time.

Website Analytics and Cookies

This website may use cookies and analytics tools to understand website traffic, improve the visitor experience and help measure the effectiveness of online content.

Some cookies may be essential for the website to work properly. Non-essential cookies, including analytics or marketing cookies, should only be used where the visitor has been given a clear choice, where required.

Further details can be found in the Cookie Policy.

Image Use

Photographs are personal to each client and are handled with care.

Photographs may be displayed on the Marcus The Photographer website, social media pages, portfolio, blog posts or promotional materials only where permission has been given, where this has been agreed as part of the booking process, or where separate consent has been provided where appropriate.

Clients may request privacy considerations at any time, particularly for private events, children, sensitive circumstances or where photographs should not be used publicly.

If you have concerns about the use of any photograph, please contact Marcus The Photographer so the matter can be reviewed.

Photograph Retention

After each photography assignment, photographs are made available in a private online gallery for 12 months. This allows time for clients to view, download and safely store their images.

After this 12-month gallery period ends, the live gallery may be removed, and the photographs associated with the assignment may be deleted from active systems. This approach helps protect privacy, keeps personal images secure, and ensures that photographs are not stored for longer than necessary.

This does not affect any images that have been separately agreed for use on the website, portfolio, social media, blog, promotional or marketing purposes.

Clients are responsible for downloading and safely storing their photographs before the gallery expiry date.

Retention of Personal Information

Personal information connected with enquiries, bookings, invoices, contracts and business records may be retained for as long as reasonably necessary for administration, accounting, legal or tax purposes.

Business and accounting records may need to be kept for longer than photographs. HMRC states that self-employed business records must normally be kept for at least 5 years after the 31 January submission deadline for the relevant tax year.

Enquiry information that does not lead to a booking may be kept for a reasonable period to allow follow-up, respond to future questions, and manage business records, unless deletion is requested and there is no legal or business reason to retain it.

Data Security

Reasonable steps are taken to protect personal information and maintain secure handling of client data.

Private galleries are intended for client access and sharing at the client’s discretion. Clients should take care when sharing gallery links with family, friends or guests.

Although reasonable care is taken, no website, email system, gallery platform or online service can be guaranteed to be completely secure.

Your Rights

You have rights in relation to your personal information.

These may include the right to:

Request access to the personal information held about you.
Ask for incorrect information to be corrected.
Ask to have personal information deleted, where applicable.
Ask for the use of your information to be restricted, where applicable.
Object to certain uses of your personal information.
Withdraw consent where consent has been used.
Request a copy of certain information in a portable format, where applicable.

Some rights may not apply in all circumstances. For example, certain business, legal, accounting or tax records may need to be retained even where a deletion request has been made.

When you make a request regarding your personal information, Marcus The Photographer will respond as soon as reasonably possible, normally within one calendar month. In some cases, proof of identity may be requested before personal information is disclosed or changed.

Where consent has been given, such as for the use of photographs in promotional materials, you may withdraw that consent at any time. Please note that withdrawal of consent may not affect uses that occurred before the request was received.

Raising a Concern

If you have concerns about how your personal information is handled, please contact Marcus The Photographer first so the matter can be reviewed and, where possible, resolved.

You also have the right to raise a concern with the Information Commissioner’s Office, the UK supervisory authority for data protection matters. The ICO can provide guidance and receive complaints about the use of personal information.
